1. Acceptance of Terms

By downloading, installing, or using SpeechyTalk ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a binding agreement between you and Speechytalk LLC ("we," "us," or "our"). Our Privacy Policy is incorporated into these Terms by reference.

2. Who May Use SpeechyTalk

You must be at least 18 years old to create an account. By creating an account, you confirm that:

• You are at least 18 years old
• You are the parent or legal guardian of any child whose information you enter into the App
• You have read and agreed to our Privacy Policy, including the COPPA section
• You have provided verifiable parental consent before entering any child profile data

3. Description of Service

SpeechyTalk is a speech therapy support app that allows parents and caregivers to create flashcard categories, record audio, build sentence cards, track milestones, and support their child's early language development.

We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where possible.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Not share your account credentials with others
• Notify us immediately at support@speechytalk.app if you suspect unauthorized access

Account sharing to circumvent subscription limits is a violation of these Terms and may result in account termination.

5. Subscriptions and Billing

SpeechyTalk offers paid subscription plans processed through the Apple App Store or Google Play Store. By subscribing, you agree to the applicable store's payment terms.

• Billing: Subscriptions are billed in advance on a monthly or annual basis
• Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
• Refunds: Refunds are governed by Apple's or Google's refund policies — we do not process refunds directly
• Cancellation: Cancel anytime through your device's App Store or Google Play subscription settings

6. Free Trial

New accounts receive a 7-day free trial with full access to premium features. The trial begins when you first create your account. Only one free trial is permitted per account.

After the trial period ends, a paid subscription is required to continue accessing premium features.

7. Your Content

You retain ownership of all content you create within the App, including flashcard text, images, audio recordings, and child profile data ("Your Content").

By using the App, you grant us a limited, non-exclusive license to store and process Your Content solely to provide the App's functionality. We do not use Your Content for advertising or share it with third parties except as described in our Privacy Policy.

8. Children's Privacy (COPPA)

SpeechyTalk complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13. All account holders must be adults (18+).

Parents may request to review, correct, or delete their child's data by contacting us at privacy@speechytalk.app.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to bypass subscription limits, trial restrictions, or security measures
• Reverse engineer or attempt to extract the App's source code
• Create multiple accounts to obtain additional free trials
• Use the App to transmit harmful, offensive, or infringing content
• Use automated tools to access or interact with the App

10. Intellectual Property

The App, including its design, code, audio content, illustrations, and all other materials (excluding Your Content), is owned by Speechytalk LLC and protected by copyright and other intellectual property laws. "SpeechyTalk" and related marks are our property.

11. Medical Disclaimer

SpeechyTalk is not a medical device and does not provide medical advice. The App is designed to support speech practice at home and is not a substitute for professional speech therapy, diagnosis, or treatment. Always consult a qualified speech-language pathologist for your child's specific needs.

12. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Speechytalk LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Termination

You may delete your account at any time from within the App (Settings → Parental Controls → Delete my account). Deletion is permanent and irreversible. We may suspend or terminate your account if you violate these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. If you are located in the European Union, you retain all rights under applicable EU consumer protection laws, which these Terms do not limit.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
